Reasons that qualify for FMLA Leave: Including the elusive serious health condition

You’re an FMLA-covered employer and you have eligible employees. Can these employees take FMLA-protected leave for any reason? Short answer: No. Many reasons do qualify for FMLA leave, but not every reason. The law and regulations limit why an employee may take FMLA leave, and you need to be aware of these limits. Failure to do so can risk a claim, which could put you in the crosshairs of a court case.

    DOT Policies & Procedures

While the motor carrier industry continues to deal with critical elements that can significantly affect service, profitability, and safety, one factor remains constant — compliance. Compliance with the regulations will be the focus of this webcast as we will cover recent and potential changes to:

    • hours-of-service rules,
    • ELDs and their effect on the hours-of-service rules,
    • procedures for handling medical cards and their relationship to their medical status on MVRs, and
    • surviving an audit from the FMCSA.

Carriers who establish policies and procedures for these critical events soon realize the impact they can have on their organizations’ quest for compliance with industry regulations. The bonus in this effort is, by establishing key and essential policies and procedures, the carrier will also realize continuity rather than disruption to their operation, and that leads to profitability!

    Ready, Set, Go!

With less than a year to be compliant with the initial ELD Mandate compliance date, if you have not yet done so, now is the time to find out what this change will mean to your operation. When the mandate was published in December of 2015, the Federal Motor Carrier Safety Administration (FMCSA) stated “Specifically, this rule… mandates ELDs for drivers currently using RODS.”

While mandated, you do have options. Discovering what is available, what is required, and what your operation needs will set your ELD transition vision. Having this vision will enable you, your leadership team, and your drivers to successfully negotiate the changes that will occur. Don’t let the change lead you, lead the change.

Unfortunately, Subpart D, “Walking-Working Surfaces,” has provided little in the way of clear, concise requirements. This is about to change, however, with the finalization of a new rule that will take major steps in overhauling the existing standard and impact an estimated 6.7 million employers. The most significant changes cover new requirements for a variety of walking-working surfaces. This includes floors, aisles, stairs, ladders, platforms, roofs, etc. This webcast will discuss these changes in contrast to current requirements to help employers understand the totality of the requirements and the impact on their workplace.

Roadside inspections remain to be the primary enforcement tool of the FMCSA. The data generated from these inspections gives the FMCSA, the transportation industry, and most importantly you and your company, all the data you need to be compliant with Federal Motor Carrier Safety Regulations. But even more than that, this data can also contribute to your bottom line by pointing out areas that threatens your profit through a drop in productivity, the cost of intervention, and unplanned maintenance cost. With the annual nationwide roadside inspection blitz taking place the first week of June 2017, a heightened awareness on the importance of a clean roadside inspection is in order. Join us as we help you prepare for one of the most common and yet more meaningful cost prevention and safety events in today’s transportation industry. This one-hour webcast will include a question and answer session.

FMLA: What the courts tell us

On its surface, the FMLA is quite simple: Eligible employees of covered employers are entitled to limited, unpaid, job-protected FMLA leave for qualifying reasons. While the statute and regulations add more meat to this, many questions remain. For example, what constitutes notice when an employee might need leave? How is “overnight” defined? These and other questions are often answered in the courts. Unfortunately, in order to obtain such an answer, an employer generally needs to be sued.

This webcast will look at a number of court cases that helped fill in some FMLA questions, so listeners can learn from other employers’ experiences.
