Exempt and Non-Exempt Employees: Debunking the most common FLSA myths

The Fair Labor Standards Act is nothing if not complicated, so it's easy to see why many employers have misconceptions about the application of the law for both exempt and non-exempt employees. This webcast will address some of the most common areas of confusion, from methods of pay such as job rates or bonuses, to classifying employees as full time or part time. Some of the many myths that will be addressed include the beliefs that:

    • Salaried employees are always exempt from overtime.
    • Exempt employees may not be required to keep a particular schedule, work a particular number of hours, or record their hours worked.
    • Non-exempt employees who work unauthorized time need not be paid.
    • Non-exempt employees need not be paid for travel time outside of normal working hours.
    • Exempt employees may not be forced to use paid time off for partial day absences or company closings.
    • Whether an employee qualifies for an exemption is based on job title.

Walking-Working Surfaces: OSHA takes major steps to overhaul the standard

For years, general industry employers have sought guidance on fall protection as Subpart D, "Walking-Working Surfaces," has provided little in the way of clear, concise requirements. That is about to change, however. OSHA has taken major steps to overhaul the current requirements in an effort to improve worker protection from slip, trip, and fall hazards on all walking-working surfaces in the workplace. OSHA believes these revisions will prevent 20 workplace fatalities and over 3,700 injuries per year that are serious enough to result in days away from work.

This webcast will discuss the proposed changes in contrast to current requirements to help employers understand the totality of the proposal and its impact on their workplace.

Fundamentals of a Compliant DOT D&A Testing Program

In 2013 two violations accounted for over fifty percent of the total "Acute" violations found during compliance reviews! They are:

    • "Failing to Implement an Alcohol and/or Drug Testing Program" as required by Section 382.115(a) and
    • "Failing to Implement a Random Controlled Substance or Alcohol Testing Program" per Section 382.304.

With the potential for fines and penalties – and your carrier's reputation on the line – it is essential for you to have a clear understanding of these safety regulations.

Managing your DOT random testing program demands attention to detail. This webcast will examine the finer points of:

    • Setting up a random pull
    • Reviewing definitions and regulatory requirements,
    • And offering industry best practices.

Understanding the connection between Workers' Compensation, Americans with Disabilities Act (ADA) and Family Medical Leave Act (FMLA) can be very difficult, but it's critical to avoid litigation.
